1. Presentation and Acceptance
Welcome to Emilia Cross. These Terms of Service (hereinafter "Terms") govern your access to and use of the Emilia Cross mobile application and related services (the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not agree to these conditions, you must not use the application.
2. Eligibility and Access
The use of Emilia Cross is strictly reserved for individuals of legal age (at least 18 years old at the time of registration). By using the Service, you represent and warrant that you have the legal capacity to enter into this agreement.
You agree to create only one personal account and to provide accurate and truthful information. The use of fake profiles, identity theft, or creating accounts for third parties is strictly prohibited.
3. Services and Features
Emilia Cross provides a premium matching platform including:
- Creation of enriched profiles (photos, videos, bio);
- Matching system between users;
- Secure instant messaging;
- Real-time video calling functionality;
- Virtual gift and credit system;
- VIP subscriptions offering exclusive benefits.
4. Virtual Credits and Subscriptions
4.1 Acquisition of Credits
"Credits" are an internal virtual currency allowing the use of certain features (video calls, sending gifts). Credits are purchased through integrated payment systems (App Store, Google Play Store, or Stripe).
4.2 Refund Policy
Unless otherwise required by law or in exceptional cases at our sole discretion, all purchases of credits and VIP subscriptions are final and non-refundable.
By purchasing digital content, you explicitly agree that the performance begins immediately after the purchase and you acknowledge that you lose your right of withdrawal once the digital content is made available to you.
5. User Generated Content (UGC) and Code of Conduct
You are solely responsible for the content (texts, images, videos) that you publish on Emilia Cross.
Prohibited Behaviors
It is strictly forbidden to publish or transmit:
- Any explicit sexual, pornographic, or suggestive content;
- Any hateful, discriminatory, racist, or offensive content;
- Any harassment, threats, or intimidation towards another user;
- Any promotion of illegal activities or prostitution/escorting services;
- Any content violating the intellectual property rights of third parties.
6. Moderation, Reporting, and Sanctions
In accordance with safety requirements, Emilia Cross implements:
- Reporting System: available on every profile and in every conversation, allowing users to alert our moderators;
- User Blocking: to cease all interaction with a specific member;
- Proactive Moderation: we reserve the right to remove any content deemed inappropriate or in violation of these Terms.
In case of violation of these Terms, we reserve the right to suspend or delete your account permanently, without notice and without refund of remaining credits or subscriptions.
7. Interaction Safety
Emilia Cross encourages its users to be cautious during their exchanges. While we make our best efforts to remove fake profiles, we cannot guarantee the real identity of every user. Never communicate banking or sensitive information to third parties met on the application.
8. Limitation of Liability
Emilia Cross acts as a hosting provider. We shall not be held liable for interactions, agreements, or disputes occurring between users. The Service is provided "as is," without any guarantee of results in your search for partners.
9. Modification of Terms
We reserve the right to modify these Terms at any time. You will be informed of any substantial modification via in-app notification or email. Continued use of the Service after modification constitutes acceptance of the new Terms.
10. Governing Law
These Terms are governed by French law. Any dispute relating to their interpretation or execution shall be subject to the jurisdiction of the competent French courts.
